INTRODUCTION

 

STAUB AVOCATS®, located at 12 Rue de l’Hôtel-de-Ville, 1204 Geneva, Switzerland (hereinafter: "we", "our", or "STAUB AVOCATS®"), places great importance on privacy protection. We are committed to ensuring the confidentiality and security of the personal data we receive or collect as part of our activities as lawyers registered with the bar.

DATA WE PROCESS

The personal data we process includes the data necessary for the exercise of our profession (hereinafter: the "Data"). Their processing is carried out in compliance with the Swiss Federal Data Protection Act (hereinafter: "LPD") and its implementing regulations. STAUB AVOCATS® is responsible for managing this Data.

We emphasize that we are subject to a legal obligation of confidentiality (lawyer-client privilege, art. 13 LLCA), and all Data covered by this obligation is processed in compliance with this legal constraint.

REASONS FOR PROCESSING YOUR DATA

 

The Data is collected and processed to allow us to provide our legal services, manage the administrative activities of the firm, control our operations, and improve the quality of our services. By using the services of STAUB AVOCATS®, you consent to the processing of your Data.

 

If necessary for the provision of our legal services or for any other purpose defined in this privacy policy, we may share your Data with third parties (advisors, related parties, courts, authorities, opposing parties, etc.), whether in Switzerland, the EU, or other countries.

In the event of Data transfer outside Switzerland or the EU, we will take the necessary measures (such as the European Commission's standard contractual clauses) or justify the transfer with relevant legal exceptions. Furthermore, we may share your Data with third parties when:

  • you consent (or the organization you work for has consented);

  • we are legally, regulatory, or professionally obligated to do so (for example, to comply with anti-money laundering requirements or sanctions);

  • it is necessary in the context of judicial proceedings or for the defense of legal rights.

When we engage third parties for services related to the execution of mandates (banks, insurance companies, translators, reviewers, IT services), we may collect and share your Data with them. This also includes the collection of data from public registers (commercial registers, land registers, debt collection offices, etc.).

SECURITY OF YOUR DATA

We have implemented security measures to protect your Data, both in electronic and physical form, against unauthorized access, misuse, disclosure, as well as against illegal modification, destruction, or accidental loss.

 

However, electronic transmission of information and data storage carry security risks; we cannot fully guarantee the security of transmitted and stored information.

DATA RETENTION PERIOD

We retain your Data for as long as necessary for the purposes for which it was collected, or as long as we have a legitimate interest in retaining it, for example, to assert or defend rights, or for archival and IT security purposes. We will also retain it if there is a legal retention obligation.

 

YOUR RIGHTS

 

You have the right to obtain information about the Data we hold and how we process it, as well as to request a copy of your Data. You may also request the rectification or deletion of your Data, restrict its processing, or object to its processing.

Additionally, you may withdraw your consent at any time, although such withdrawal may lead to the early termination of the ongoing mandate. However, even after withdrawing your consent, we may continue processing your Data if required or permitted by law.
